Terms of Service

These terms govern your use of Curious Prospector, a prospect research tool operated by Curious Brand ("we", "us"). By using the product you agree to them. If you are using it on behalf of an organisation, you confirm you may accept these terms for that organisation.

What the product does

Curious Prospector helps you find companies that might need what you sell, research them, score how well they fit your ideal customer profile, and draft a first outreach message.

Curious Prospector is built on large language models with live web search. Model output is a research aid, not a verified fact. It can be wrong, out of date, or confidently mistaken about a company, a person or a contact detail.

You are responsible for checking anything before you act on it — especially a company name, a website, a person's name, a job title or an email address. Do not treat a research brief as verified.

Access, invitations and spaces

Access is by invitation. Your account belongs to a "space" — a workspace with its own Business DNA, target lists and pipeline. Everything you find, score and draft runs on that space's settings.

Your invitation may be issued with a free trial. Unless we tell you otherwise in writing, a trial runs for 14 days and includes 20 full company analyses. Contact-lookup allowances are set per account and shown in the product.

We may change, suspend or withdraw access to an account or a space — including at the end of a trial, or if these terms are breached. Where practical we will tell you first.

Who can see your data

Members of your space can see that space's Business DNA, target lists, research and pipeline.

Our staff acting as platform administrators can access data across all spaces in order to operate, support and troubleshoot the service, and to investigate misuse. We access it for those purposes only. This is a deliberate disclosure: it is a real capability of the product, not a theoretical one.

We do not sell your data, and we do not use one space's data to generate results for another.

Your responsibilities when you contact people

This product produces drafts. You decide whether to send anything, to whom, and how. You are the controller of any outreach you send, and you are responsible for it being lawful.

  • Comply with applicable direct-marketing and data-protection law — in the UK that includes UK GDPR and PECR, and equivalent rules elsewhere (for example CAN-SPAM in the US, CASL in Canada).
  • Have a lawful basis for contacting a person, and identify yourself honestly in every message.
  • Honour opt-outs and unsubscribe requests promptly, and keep a record of them.
  • Do not send bulk unsolicited messaging, mislead recipients about who you are, or disguise the commercial nature of a message.
  • Do not use the product to build or sell contact lists, to scrape at scale, or to target individuals in their personal capacity rather than a business role.
  • Do not use it to target special-category data, minors, or anyone in a context where marketing would be inappropriate or unlawful.

Acceptable use

  • Do not share your login. One person per account.
  • Do not attempt to access another space's data, bypass access controls or usage limits, or probe the service for vulnerabilities without written permission.
  • Do not resell, sublicense or white-label the product, or use it to build a competing service.
  • Do not use it for anything unlawful, or to harass, defraud or deceive anyone.
  • Do not overload the service with automated requests. Usage is metered and capped, and we may throttle or suspend an account that is consuming disproportionate resources.

Your content and your data

You keep ownership of what you put in — your Business DNA, target lists, notes and pipeline — and of the drafts produced for you. You grant us the licence needed to host and process it in order to provide the service.

We process your data to run the product, including sending relevant parts of it to the AI and enrichment providers listed in our Privacy Policy. Those providers process it on our instructions.

Fees

Where an account is paid, the fee, billing period and any usage allowances are those agreed with you in writing. Trials are free and carry no obligation to continue.

Some features consume metered third-party credits (for example contact lookups). Allowances are shown in the product and may be capped per account.

Availability

We aim to keep the service available and to make sensible backups, but we do not promise uninterrupted availability. We may take it down for maintenance, and we may change or remove features.

The service depends on third parties — AI providers, enrichment providers, hosting. Their outages will affect it.

No warranty on results

The service is provided "as is". We do not warrant that results will be accurate, complete, current or fit for a particular purpose, that a prospect is a genuine opportunity, or that any outreach will produce a reply, a meeting or revenue.

Nothing here excludes liability that cannot lawfully be excluded.

Liability

Subject to the paragraph above, neither party is liable for loss of profit, loss of business, loss of goodwill, or indirect or consequential loss.

Our total liability arising out of or in connection with these terms is limited to the greater of the fees you paid us in the 12 months before the claim, or £100.

You are responsible for your own outreach. If a claim is brought against us because of messages you sent or the way you used contact data, you will indemnify us for it.

Ending it

You may stop using the service at any time and ask us to close your account.

On closure we delete or anonymise the account and the work owned by it, subject to any records we must keep by law. Data belonging to a space you were a member of may remain with that space.

Changes to these terms

We may update these terms. If a change is material we will ask you to accept the new version when you next sign in, and record that acceptance. Continuing to use the service after that means you accept the current version.

Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
